The Buhari administration has been sued by the children of the late Mrs. Kudirat Abiola in Abuja’s ECOWAS Court of Justice over the murder of their mother.
The children are contesting the “violation of the fundamental human rights to life and dignity of human person of the late Mrs. Abiola” in the lawsuit ECW/CCJ/APP/62/2022 that their attorney Femi Falana, SAN, filed on their behalf.
The suit was instituted by Khafila Abiola, Moriam Abiola, and Hadi Abiola on behalf of all Kudirat’s Children.
The Plaintiffs contend that the Defendant violated Articles 1,4,5,18, and 23 of the African Charter by refusing or failing to protect the life of Late Alhaja Kudirat Abiola in the Republic of Nigeria.
“The combined effect of the said provisions of the African Charter and the Constitution of Federal Republic of Nigeria is that states will be held responsible if they fail to act with due diligence to prevent violations of the rights or actively involved act which amount to the violation of the plaintiff right (as in this case), and for providing adequate compensation,” the plaintiffs argued.
Kudirat Abiola’s children are demanding compensation of $10 million for the unlawful killing of their mother.
However, a date has not been set for hearing of the suit.
