The Appeal Court in Makurdi presided by a three-panel judge has ruled in the favour David Mark after it dismissed the petition of the All Progressives Party Senatorial candidate for the Benue South senatorial rerun election, Comrade Daniel Onjeh.
One of the judges, Oyebisi Omoleye said the ruling was based on the grounds that the election petition ought to be filed within 21 days after the declaration of the election results, but the petition was filed on the 22nd day and it rendered it “incompetent and impotent”, that David Mark is rightful and lawful winner of the election
The Counsel to the defeated APC candidate, Sunday Ayegba said: “we are not happy with the decision of the court but there is nothing we can do about it.”
