Justice Nnamdi Dimgba of the Federal High Court Abuja has nullified the suspension of Senator Ovie Omo-Agege.

The Senate had, on April 13, suspended the senator for 90 legislative days over his comment that the amendment to the Electoral Act 2010 seeking the re-ordering of the general elections was targeted at President Muhammadu Buhari.

The judge, in a judgment delivered on Thursday, held that though the legislature has the power to deal with erring members, it did not follow due process in arriving at its decision.

 Justice Dimgba also held that the reason given for the suspension of Omo-Agege by the Ethics and Privileges Committee was a fundamental breach of the Constitution and hence the suspension is a nullity.

The judge while declaring that the nullification is with immediate effect, also ordered the Senate to pay Omo-Agege all his salaries and allowances due to the suspension.
